01 Nature of Services
Xcalious Technology operates as a technology service provider that enables businesses ("Merchants") to create and manage their e-commerce websites. We provide software, hosting, and technical infrastructure only.
We do not own, sell, or control any products or services listed on merchant websites.
02 No Role in Transactions
Xcalious Technology is not a party to any transaction between customers and merchants. All purchases, payments, and deliveries are handled directly by the merchant.
03 Merchant Responsibility
Merchants are solely responsible for:
- Product listings, descriptions, and images
- Pricing, discounts, and taxes
- Inventory and order fulfillment
- Customer support and dispute resolution
- Legal compliance
04 Product Disclaimer
Xcalious Technology does not guarantee product quality, safety, legality, or accuracy. All product-related issues must be resolved with the respective merchant.
05 Pricing & Content
All pricing and product information is managed by merchants. We are not responsible for incorrect pricing or misleading content.
06 Payment Disclaimer
Payments are processed through third-party payment gateways. Xcalious Technology is not responsible for payment failures, delays, or refunds.
07 Limitation of Liability
Xcalious Technology shall not be liable for any indirect or direct damages arising from transactions, product issues, or platform usage. Liability is limited to the service fees paid by the merchant.
08 Indemnification
Merchants agree to indemnify and hold harmless Xcalious Technology against any claims, damages, or disputes arising from their business operations or customer interactions.
09 Data & Privacy
We handle platform-related data. However, all customer data collected on merchant websites is controlled by the merchant.
10 Service Availability
We do not guarantee uninterrupted service. Temporary downtime may occur due to maintenance or technical issues.
11 Legal Compliance
Merchants are responsible for complying with all applicable laws, including IT Act 2000, Consumer Protection Rules, and GST regulations.
12 Account Termination
We reserve the right to suspend or terminate accounts involved in illegal or harmful activities.
13 Policy Updates
Xcalious Technology may update this policy at any time. Continued use of the platform indicates acceptance of updates.
